Terms of Service

1. Acceptance of Terms
By accessing or using PulseGuard (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree to these terms, you may not use the Service.
2. Description of Service
PulseGuard provides AI-powered uptime monitoring, status pages, incident management, and alerting services. We offer multiple subscription tiers (Free, Pro, and Business) with varying levels of features and capacity. Service features and availability may change over time as we improve and expand the platform. We will provide reasonable notice of any material changes to the Service.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe have been compromised.
4. Acceptable Use
You agree not to use the Service to: (a) monitor endpoints you do not own or have authorization to monitor; (b) conduct denial-of-service attacks or load testing against third-party services; (c) transmit malicious code or attempt to gain unauthorized access to our systems; (d) resell or redistribute the Service without written permission; or (e) violate any applicable local, state, national, or international law.
5. Payment and Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. If payment fails, we will attempt to charge your payment method again and may suspend your account after repeated failures. You are responsible for all applicable taxes. Price changes will be communicated at least 30 days in advance.
6. Limitation of Liability
To the maximum extent permitted by law, PulseGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to PulseGuard in the twelve months preceding the claim. This limitation applies regardless of the form of action or theory of liability.
7. Service Level Agreement
Business plan customers are eligible for our 99.99% uptime Service Level Agreement. If we fail to meet this target in any calendar month, eligible customers may request a service credit as outlined in our SLA documentation. Free and Pro plans are provided on a best-effort basis and are not covered by an SLA.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes via email or a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised terms. If you do not agree with the changes, you may close your account before the effective date.
